Terms and Conditions

This website, available at www.hangar18.pt, is owned by João Vasco Coutinho de Almeida, with registered address at Rua Eng. Carlos Bóia, 19, 3810-702 Aveiro, Portugal, Tax Identification Number 230 553 516, hereinafter referred to as Hangar18.

These Terms and Conditions govern access to and use of the website, as well as purchases made through the online store.

Use of the website implies acceptance of these Terms and Conditions, in the version in force at any given time.

1. Use of the Website

The user undertakes to use the website and its contents in accordance with applicable law and shall refrain from any unlawful use or any use that may harm Hangar18, third parties, or the proper functioning of the website.

The information provided on the website is regularly updated. However, errors, omissions, or differences may occur between the images shown and the product actually supplied, particularly regarding colour shades, packaging, or minor changes introduced by manufacturers.

Hangar18 reserves the right to change, at any time and without prior notice, the contents, products, prices, promotions, commercial conditions, or services made available, without prejudice to orders already confirmed.

2. Registration and Customer Account

To make certain purchases, the customer may be required to create an account.

The customer is responsible for the accuracy and updating of the information provided and for keeping their login credentials confidential.

The account is personal and may not be transferred or made available to third parties.

3. Products and Availability

All products are subject to stock availability.

The presence of a product on the website does not guarantee its immediate availability.

If an ordered product is unavailable, Hangar18 will contact the customer and may propose:

  • replacement with an equivalent product;
  • waiting for stock replenishment;
  • or a refund of the corresponding amount.

4. Prices

Prices displayed to final consumers are expressed in euros and include VAT at the applicable legal rate, unless otherwise stated.

Shipping costs are not included in the product price and are shown separately during the checkout process.

In the event of an obvious pricing error resulting from a technical failure, data-entry error, or any other clearly abnormal situation, Hangar18 may cancel the order and refund in full any amounts already paid.

5. Special Commercial Conditions and Customer Groups

Hangar18 may assign specific commercial conditions to certain customers or customer groups.

These conditions may include, among others:

  • professional discounts;
  • conditions associated with agreements or partnerships;
  • reseller conditions;
  • specific commercial conditions assigned individually.

Discounts and benefits may vary depending on the product, brand, category, campaign, or applicable commercial conditions.

Certain products may not be eligible for any discount.

Conditions assigned to a customer account are personal and non-transferable.

Hangar18 may request documentation or other appropriate evidence to confirm the customer's eligibility for specific commercial conditions.

Providing false information, misuse of an account, or allowing third parties to benefit from commercial conditions assigned to an account may result in the suspension or cancellation of those benefits.

Special commercial conditions may be changed or withdrawn by Hangar18, without prejudice to orders already completed.

6. Conditions for Professionals

Professional conditions are intended for active professionals whose activity falls within the eligibility criteria defined by Hangar18.

To validate professional status, Hangar18 may request suitable proof containing only the information necessary to confirm the customer's identity and professional organisation or body.

Hangar18 may also consider other appropriate validation elements, including customer history or the use of a professional delivery address.

The granting of professional conditions does not automatically provide access to products whose sale is subject to specific legal or professional requirements.

For such products, additional identification, professional registration, licence, or other relevant evidence may be required.

7. Orders

Placing an order implies acceptance of these Terms and Conditions.

After an order has been completed, a confirmation will be sent to the email address provided by the customer.

Automatic confirmation of an order does not necessarily mean that all items have been definitively reserved. Orders remain subject to stock and payment confirmation.

8. Payments

Available payment methods are shown during the checkout process.

Orders will be processed after payment has been confirmed, except where another payment method with specific conditions is available.

Payments are made in euros.

Any currency conversion fees charged by banks or payment providers are the responsibility of the customer.

9. Dispatch and Delivery

Orders are shipped to the address provided by the customer.

Shipping costs are calculated according to factors including destination, weight, dimensions, and order value.

Delivery times shown are estimates.

Where transport is carried out by an external carrier, delays may occur for reasons beyond Hangar18's control.

Whenever possible, the customer should inspect the external condition of the parcel upon delivery.

If there are clear signs of transport damage, the customer is advised to record the issue with the carrier and notify Hangar18 as soon as possible.

10. Incorrect, Damaged or Non-Conforming Products

If the customer receives a product different from the one ordered, a damaged product, or a product showing a lack of conformity, they should contact Hangar18 at geral@hangar18.pt, providing, where possible:

  • order or invoice number;
  • identification of the product;
  • description of the issue;
  • photographs allowing an initial assessment of the situation.

The submission of photographs is intended solely to allow an initial assessment and does not affect the consumer's statutory rights.

11. Legal Guarantee and Lack of Conformity

Goods sold to consumers benefit from the statutory guarantee and rights provided for under applicable Portuguese law, including the legal regime governing the sale of consumer goods.

In the event of a lack of conformity, the consumer may, subject to the applicable legal requirements, be entitled to remedies such as:

  • repair;
  • replacement;
  • proportional price reduction;
  • termination of the contract.

The availability of each remedy depends on the legal conditions applicable to each situation.

The guarantee does not cover, among other situations, damage resulting from:

  • incorrect use;
  • normal wear and tear;
  • negligence;
  • accidents;
  • improper modifications or repairs;
  • inadequate storage;
  • use contrary to the manufacturer's instructions.

12. Right of Withdrawal

For distance contracts, consumers have, in accordance with applicable law, a period of 14 calendar days in which to exercise their right of withdrawal without having to provide a reason.

For the purchase of goods, this period generally starts on the day on which the consumer, or a third party designated by the consumer, acquires physical possession of the goods.

To exercise this right, the consumer must communicate their decision unequivocally to:

geral@hangar18.pt

or by post to:

Hangar18
Rua Eng. Carlos Bóia, 19
3810-702 Aveiro
Portugal

13. Condition of Returned Goods

The consumer may handle the product only to the extent necessary to establish its nature, characteristics, and functioning.

The consumer may be held liable for any reduction in the value of the goods resulting from handling beyond what is necessary for this purpose.

Whenever possible, the product should be returned with its accessories, manuals, and original packaging.

The absence or opening of the original packaging does not, by itself, result in the automatic loss of the right of withdrawal, without prejudice to the exceptions provided by law.

14. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in cases excluded by law, including, where applicable, goods which are:

  • made to the consumer's specifications;
  • clearly personalised;
  • by their nature unsuitable for return;
  • sealed and unsuitable for return for reasons of health protection or hygiene if unsealed after delivery;
  • or covered by any other statutory exception.

15. Return of Goods

After notifying Hangar18 of the decision to withdraw from the contract, the consumer must return the goods without undue delay and no later than within the statutory period of 14 days.

Unless the return results from an error by Hangar18, a defective product, or a lack of conformity, the direct costs of returning the goods are borne by the consumer.

16. Refunds

Where the right of withdrawal is validly exercised, Hangar18 will reimburse payments received, including the cost of the least expensive standard delivery method offered.

Additional costs resulting from the customer's choice of a more expensive delivery method will not be refunded.

Where possible, refunds will be made using the same payment method originally used for the purchase, unless expressly agreed otherwise.

Where this is not technically possible, the customer may be asked to provide an IBAN for reimbursement by bank transfer.

Hangar18 may withhold reimbursement until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first.

17. Products Subject to Specific Legal Requirements

Certain products sold by Hangar18 are subject to specific legal requirements regarding their sale, acquisition, or use.

Where applicable, Hangar18 may request documentation proving age, identity, licence, professional status, qualification, or any other legal requirement necessary for the purchase of the product.

The order may be refused or cancelled where the legally required conditions are not demonstrated.

18. Intellectual Property

The contents of the website, including texts, images, logos, graphic elements, and other protected content, belong to Hangar18 or are used with the authorisation of their respective rights holders.

Unauthorised reproduction, use, or exploitation of such content is prohibited.

19. External Links

The website may include links to third-party websites.

Hangar18 does not control and accepts no responsibility for the contents, privacy policies, or practices of those websites.

20. Data Protection

Personal data is processed in accordance with applicable law and the Privacy Policy available on the website.

Data collected for the validation of special commercial conditions shall be limited to what is necessary to confirm the customer's eligibility.

21. Changes to the Terms and Conditions

Hangar18 may amend these Terms and Conditions whenever necessary.

The version applicable to an order will be the version in force at the time the order is placed.

22. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by Portuguese law.

In the event of a consumer dispute, the applicable legal rules concerning court jurisdiction and alternative dispute resolution mechanisms shall apply.

Consumers may contact the competent consumer alternative dispute resolution entities in accordance with applicable law.
